Under Article 6 of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy, users of the site www.o2m.international and/or www.o2m.world are informed of the identity of the various stakeholders in the context of its implementation and monitoring.

2. General conditions of use of the site and the services offered

These General Conditions of Use are concluded between O2M and, on the other hand, a user browsing and/or using the services offered on the website www.o2m.international and/or www.o2m.world (hereinafter the " Site ").

ARTICLE 1 - DEFINITIONS

The terms starting with a capital letter in these General Conditions of Use have the meaning given to them below: 

Site: designates the website accessible at the URL address www.o2m.international and/or www.o2m.world 

User: means any adult and capable natural person browsing and/or using the services on the Site. General Conditions of Use: refers to these General Conditions of Use concluded between O2M and the user which govern the use of the services offered by O2M on the Site (hereinafter the “T&Cs”).


ARTICLE 2 - ACCEPTANCE AND MODIFICATION OF THE T&Cs

The General Terms and Conditions are made available to the User on the Site where they are directly consultable and accessible in French at any time at the bottom of the page of the Site. By browsing the Site, the User acknowledges having accepted the T&Cs in force on the day of their navigation. O2M reserves the right to modify these T&Cs at any time in order to adapt them to the evolution of the services offered on the Site, to comply with all legal and jurisprudential developments or to make editorial and/or technical adaptations.


ARTICLE 3 - PURPOSE OF THE SITE

The Site is intended to provide any interested person with information on O2M's activity (history, services, news, etc.), to create a customer area and to allow any User to contact O2M. 

As such, the User can contact O2M in four ways: - By filling out the contact form; - By writing to the contact email address provided on the site; - By writing by post to the postal address provided on the Site;- By calling the telephone number provided on the Site.


ARTICLE 4 - CREATION OF THE CUSTOMER AREA

The user is not required to create a customer space to browse the Site. 

If a customer area is created, the password and identifier allowing the User to access their account are strictly confidential and have the function of protecting their personal data. The User undertakes not to communicate them to any third party and to keep them in a place known only to him. The User is solely responsible in the event of loss or communication of his identifiers to an unauthorized third party. O2M cannot be held liable in the event of fraudulent use of the User's customer area due to negligence. of the latter in the conservation and protection of their connection identifiers.


ARTICLE 5 - INTELLECTUAL PROPERTY

O2M is the exclusive owner of the intellectual property rights on all visual elements (texts, logos, images, graphic charter), sound, software as well as the brands and databases composing and appearing on the Site, and does not grant any license , nor any right other than that of using the Site in accordance with these General Conditions. 

Any reproduction, representation and distribution of these elements without prior written authorization from O2M exposes offenders to legal action. O2M reserves the right to take legal action against any act of counterfeiting, unfair competition or parasitism committed against it and more generally any act infringing its rights. ARTICLE 6 - LIABILITY

The User and O2M are responsible, towards each other, for the proper execution of these T&Cs in accordance with the rules of common law. 

O2M's liability can only be incurred in the event that the damage caused to the User, personal, is directly attributable to the latter's non-performance of the T&Cs. The User acknowledges that in the event of violation of these T&Cs and in particular in the event of use of the Site clearly going against the laws and regulations in force in France, public order or good morals, O2M reserves the right to take any action or undertake any step of a nature to protect its rights or those of third parties. The Site is accessible 7 days a week and 24 hours a day, subject to cases of force majeure and maintenance periods set at the discretion of O2M. If a technical problem were to make access to the Site, O2M will make its best efforts to restore access to the Site, without however its liability being incurred in this respect. The User is solely responsible for the proper functioning of the computer equipment which allows him access to the Site. O2M cannot be held responsible for any difficulties the User may have in accessing the Site linked to the User's computer equipment. Costs generated by the use of the Site (such as for example computer equipment: mobile phone, tablet, computer) are the sole responsibility of the User.


ARTICLE 7 - INDEPENDENCE OF CLAUSES

The fact that one of the clauses of these T&Cs is deemed void or deemed unwritten will have no effect on the other clauses, unless it is an essential clause of these T&Cs or if the clause is interdependent on 'another contractual stipulation.


ARTICLE 8 - RESOLUTION OF DISPUTES

In the event of a dispute relating to the interpretation or execution of these T&Cs, O2M and the User will seek an amicable agreement and will communicate the necessary information to each other.


ARTICLE 9 - APPLICABLE LAW

These T&Cs are governed by French law.


ARTICLE 10 - COMPETENT JURISDICTION

Any dispute relating to the formation, interpretation and execution of these General Conditions which has not been resolved amicably falls within the jurisdiction of the French courts.


3. Description of services provided

The site www.o2m.international and/or www.o2m.world aims to provide information regarding all O2M activities.

O2M owns the intellectual property rights or holds the usage rights on all elements accessible on the site, in particular texts, images, graphics, logos, icons, sounds, software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without prior written authorization from O2M.

Any unauthorized use of the site or one of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

6. Limitations of liability

O2M cannot be held responsible for direct or indirect damage caused to the user's equipment, when accessing the site www.o2m.international and/or www.o2m.world, and resulting either from the use of a hardware not meeting the specifications indicated in point 4, or the appearance of a bug or incompatibility.

O2M cannot also be held responsible for indirect damage (such as loss of market or loss of opportunity) resulting from the use of the site www.o2m.international and/or www.o2m.world.

Interactive spaces (possibility of asking questions in the contact area) are available to users. O2M reserves the right to delete, without prior notice, any content posted in this space which contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, O2M also reserves the right to call into question the user's civil and/or criminal liability, particularly in the event of messages of a racist, offensive, defamatory, or pornographic nature, regardless of the medium used (text , photography…).

7. Management of personal data

In France, personal data are notably protected by law n° 78-87 of January 6, 1978, law n° 2004-801 of August 6, 2004, article L. 226-13 of the Penal Code and the European Directive of October 24, 1995.

When using the site www.o2m.international and/or www.o2m.world, the following may be collected: the URL of the links through which the user accessed the site www.o2m.international and/or www.o2m.world, the user's access provider, the user's Internet Protocol (IP) address.

In any case, O2M only collects personal information relating to the user for the purposes of certain services offered by the site www.o2m.international and/or www.o2m.world. The user provides this information in full knowledge of the facts, particularly when he enters it himself. The user of the site www.o2m.international and/or www.o2m.world is then informed whether or not they are obliged to provide this information.

In accordance with the provisions of articles 38 and following of law 78-17 of January 6, 1978 relating to data processing, files and freedoms, any user has a right of access, rectification and opposition to personal data concerning him, by making his written and signed request, accompanied by a copy of the identity document with signature of the holder of the document, specifying the address to which the response must be sent.

No personal information of the user of the site www.o2m.international and/or www.o2m.world is published without the user's knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Only the hypothesis of the repurchase of O2M and its rights would allow the transmission of said information to the possible purchaser who would in turn be bound by the same obligation of conservation and modification of data with respect to the user of the site www .o2m.international and/or www.o2m.world. The site is not declared to the CNIL because it does not collect personal information.

The databases are protected by the provisions of the law of July 1, 1998 transposing directive 96/9 of March 11, 1996 relating to the legal protection of databases. 

The information collected in the contact form is processed by O2M, data controller, to whom it is intended for the purposes of responding to the request made. ARTICLE 1

As part of this contract, O2M GROUPE is required to process personal data. In this context, O2M GROUPE, as responsible for the processing of said data, undertakes to respect its obligations with regard to French regulations regarding personal data and in particular the provisions of Law No. 78- 17 of January 6, 1978 (“Informatique et Libertés” Law) as well as Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on data protection, which entered into force on May 25, 2018 (“GDPR ), and to take any useful technical and organizational measures to ensure its security and confidentiality.


ARTICLE 2

As such, O2M GROUPE processes the personal data strictly necessary for the execution of this contract, for possible marketing and commercial prospecting operations, for the management of unpaid debts and possible disputes, and for compliance with the legal and regulatory obligations of O2M GROUP. 

Personal data is intended for O2M GROUPE staff and external services responsible for fulfilling its social, accounting and tax obligations as well as its possible subcontractors and service providers. They are kept for the duration strictly necessary for the above purposes.


ARTICLE 3

Natural persons whose personal data are processed have a right of access, rectification, opposition, deletion, limitation as well as the right to portability of personal data. Any request in this regard must be sent to the following email address: support@o2m-groupe.com . If they deem it useful, they can lodge a complaint with the CNIL concerning the way in which O2M GROUPE processes their personal data.


ARTICLE 4

In the event of a violation of personal data likely to create a risk for its rights and freedoms, O2M GROUPE undertakes to notify, under the conditions provided for in Articles 33 and 34 of the GDPR, the violation in question to the authority of competent control (CNIL) no later than 72 hours after becoming aware of it, and to the person concerned as soon as possible.


8. Hypertext links and cookies

  • The site www.o2m.international and/or www.o2m.world contains a certain number of hypertext links to other sites, set up with the authorization of O2M. However, O2M is not able to verify the content of the sites visited, and will therefore assume no responsibility for this.
  • Browsing the site www.o2m.international and/or www.o2m.world may cause the installation of cookie(s) on the user's computer. 9. Applicable law and attribution of jurisdiction

Any dispute relating to the use of the site www.o2m.international and/or www.o2m.world is subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris. The translation of these T&Cs is for information purposes only, the French version being authoritative.
